End User License Agreement (EULA)

1. License Grant

GK Consulting Ltd grants you a non-exclusive, non-transferable, perpetual license to use FlexFMX for software development, subject to the purchased version and these terms.

2. Version-Locked License

Your license applies only to the specific version of FlexFMX purchased.

  • You may continue to use that version indefinitely.
  • Future versions are not included unless covered by an active maintenance agreement or purchased upgrade.
  • Major releases may include breaking changes and are treated as separate product versions.

3. Maintenance Agreement (1-Year Only)

Maintenance is optional and provided strictly on a 12-month term from the date of purchase or renewal.

3.1 Included During Active Maintenance

  • Bug fixes and defect corrections
  • Updates to support new versions of Delphi released during the maintenance period
  • Incremental improvements and compatibility updates

3.2 After Maintenance Expires

  • You retain perpetual rights to the last version released during your active maintenance period
  • No further updates, fixes, or Delphi compatibility updates will be provided
  • Continued use of the software is permitted without support

4. Paid Upgrade Policy

New major versions of FlexFMX may be released independently of maintenance.

  • Major upgrades are not included in maintenance unless explicitly stated
  • Upgrade pricing may be offered at a discounted rate to recent customers
  • Each major version is treated as a separately licensed release

5. License Types

  • Per-Developer: One license per individual developer
  • Per-Seat: One license per machine or user
  • Team License: Defined number of developers within one organisation

6. Restrictions

  • No reverse engineering, decompiling, or disassembly
  • No redistribution, resale, or sublicensing without written permission
  • No sharing of license keys across individuals or organisations
  • No embedding into competing frameworks or toolkits

7. Intellectual Property

All rights, title, and ownership remain with GK Consulting Ltd. This license grants usage rights only.

8. Audit Rights

GK Consulting Ltd reserves the right to audit license usage with reasonable notice.

9. Warranty Disclaimer

FlexFMX is provided “as is” without warranty of any kind, express or implied.

10. Limitation of Liability

GK Consulting Ltd shall not be liable for any indirect, incidental, or consequential damages arising from use of the software.

11. Termination

Failure to comply with these terms results in immediate termination of license rights.

12. Governing Law

These Terms are governed by the laws of England and Wales.
